Faily Kurds are victims of Political Prisoners Foundation which is penetrated by Ba'athiests, and departments corruption

Shafaq News/ Researchers and specialists and academics shed light on the axis of the last issue of the Kurds Faily. They discussed the law of political prisoners, in a symposium held by the Kurdish House at the Hall of Shafaq Foundation of Culture and Media for the Faily Kurds , entitled " Faily Kurds and the Political Prisoners Foundation ."

 

 

 

 

 

 

The head of Shafaq Foundation Ali Hussein Faily at the beginning of the seminar spoke about the issue of Faily Kurds, referring to the sacrifices of the martyrs and the forcibly displaced and the claim for their rights, adding that "The harm that  they had suffered from still exists so far, although the former regime had deprived them everything. "

He confirmed that the Faily Kurds are "victims particularly those who are political prisoners ."
"The Faily Kurds are victims with no fault," ​​and wondered about the problematic identification of the Faily political prisoner, "How can the Faily Kurds prove to the Political Prisoners Foundation their being imprisoned or detained after the former regime had confiscated all their belongings and identification papers."

 

 

 

The former National Assembly member ,and the legal adviser Fa'iza Bapakhan touched on the Law No. 4 of 2006, which formalized the foundation of political prisoners, stressing on the definition of the rights guaranteed by the Foundation of the political prisoners law , including compensating them  financially and morally for their suffering during their  detention and to provide care for the  covered in coordination with the other non-official institutions in Iraq, and providing opportunities for work and study, including the completion of their higher education without the requirement of age, and to provide facilities to the prisoners and their families to live a decent standard of living.
Then Bapakhan put a definition that which is subject to the conditions of political prisoner, according to the Foundation of political prisoners Law, saying , "The prisoner is that who was convicted and has judgment excerpt because of disagreeing opinion with the former regime or because of his dealings with another party or belonged to a party other than the Ba'ath Party" .
She added that "that who  does not have a judgment excerpt can bring two witnesses to prove he was a political prisoner," pointing out that the expelled Faily Kurds have been deprived of identity papers.
Bapakhan spoke about the structure of the organization and its funding noting the absence of the use of the available funds of the institution to establish investment projects.
In their answers to questions of the attending interposers  said Bapakhan that "covered by the procedures of the institution if it was not an employee, he is given a pension calculated period of imprisonment for purposes of service and retirement, and if he is an employee, he deserves a career salary in addition to the salary of organization for ten years," she said, adding that after that. " The prisoner would choose one of them."
She pointed to the allocation of a piece of land for the  covered by the law of political prisoners in addition to banking facilities on the loan and construction licenses, taxes and fees and give  him priority in the public service and other privileges.

 

 

Some interposers said that their transactions delivered to the Foundation in April has not been promoted so far and Bapakhan responded, that this was due to the momentum of work in addition to raising the transactions to the accountability and justice for checking names, noting that they had found that 400 people out of 7000 of the covered, have been accused by the accountability and justice board .

 

 

 

 

 

After that Fayrouz Hatem member of the care for the institution of political prisoners spoke about the tasks of the care council and of "supervisory role of it," and about the structural management of the Foundation and she criticized the survival of officials in office for a long time hinting to the survival of the foundation's director by agency Jassim Mohammed Ja'afer in the office, "since the previous government, despite the passage of two elections, "pointing out that the organization situation is " tragic. "
"It is supposed that the political prisoner would take all the privileges that the law of the foundation formation guaranteed," adding that "there was a project presented to the House of Representatives to amend the name of the organization and duties to be an institution of prisoners and political prisoners, to include a wider segment."
She complained of poor performance and injustice on some segments of the prisoners and set an example that "the prisoners of the Iraqi Communist Party in 1963 were not included by law, despite their eligibility," she said, referring to "the political motivations behind this refusal, as they invoked some positions of the Communists (the National Front ) years in the seventies of the last century. "
She pointed to the fact that it's surprising "Those politicians were arrested many years before (the National Front  ."
Hatem Confirmed on the decision of the High Criminal Court which counted what Faily Kurds suffered as genocide as to be an opportunity which was not exploited, and wondered, "What result did the victims get after  the decision .The executive power was supposed to exercise its role about that ," pointing to the problems in the presidency of the institution of political prisoners and other institutions and "breach of consensus" agreed upon.

 

 

Some of the Interposers said that they have been imprisoned in the seventies of the last century , but they did not obtain justice in this aspect, while the law of political prisoners included people who were detained on a dishonorable affairs and many members served the former regime.
Fa'iza Bapakhan explained that 300 transactions were completed during the past month without asking the person for the sentence excerpt if it was not available . She indicated that the names of the counterfeiters would be revealed.
She said that if a person's request is rejected for inclusion in the institution of political prisoners he can go to the discrimination court during one month, , and if his request is rejected again he can go to the appellate court.
The High Court has issued in the 29/11/2010 its decision against the fifteen convicts who had killed and displaced and deported the Faily Kurds. It counted the crimes committed against the Faily Kurds  as a crime of genocide.
The region's president Massoud Barzani and after the decision of the High Criminal Court about the Faily Kurds 29/11/2010 called all the political blocs  participating in the federal Iraq and the Kurdistan Region to follow up what serves justice for the Faily Kurds in all respects and to make available all means to compensate them to return all their confiscated rights by the former regime.
The Council of Ministers pledged after the decision of the Supreme Iraqi Criminal Court to remove all the bad effects caused by the unfair decisions issued by the former regime against the Iraqi people from the Kurdish Faily (such as Iraqi citizenship deprivation  and confiscation of movable and immovable property and the other usurped rights).
The Presidency of the Republic decided to open up an Office to adopt the issue of the crime of genocide against the Faily Kurds and the decision of the Iraqi Supreme Criminal Court .
