Khalid Abdul-Jabbar: Despite all the legislations and the decisions but dismissed politicians still suffer from injustice
Shafaq News / On this subject "Shafaq News" had an interview with the member of the Central Committee of the dismissed politician and legal adviser of the Committee and Chairman of the scrutiny committee Khalid Abdullah Jabbar.
* When and How did dismissed politicians case begin ?- The dismissed politicians question began for the first time on 24/10/1971 and by the decision of the dissolved Revolutionary Command Council No. 1323, which began after the announcement of the Progressive National Front consisting of the dissolved Baath Party and opposition parties in the forefront of which was the Iraqi Communist Party, not as known that dismissed politicians case began after 2003. The text of the Book of the General Secretariat of the Council of Ministers No. 5300 dated 12/6/2005 in paragraph 3 that "The provisions of resolution of dissolved Revolutionary Command Council No. 1323 of 1971 to calculate the duration of the dismissed and expelled and isolated, retiring for political reasons outside the job service for the purposes of promotion and retirement ".
Q: What are the bases on which it relied upon to accept applications of dismissed politicians?
- A decision or set of resolutions had been issued by the Governing Council and the book on 29/9/2003 before the book of the General Secretariat of the Council of Ministers No. 5300, a press release No. 66, which stated in paragraph 3 of the "Bringing back all dismissed politicians or forced to leave their job for reasons exclusively political, to their jobs with the term of the calculation for the purposes of service and retirement. * Does the decision No. 81 of 2010 issued by the Council of Ministers on the amounts previously received by the staffs invalidation includes political dismissing plaintiff?
- The decision 81, did not include the plaintiff of political dismissing and those about whom decisions from the Commission of Verification had been issued for non-inclusion of political dismissing and based on the decision of the State Council No. 211 / discipline / distinction / 2008, which was to withdraw all the privileges and rights granted to them on the basis of political dismissing, if any. The legal department at the General Secretariat of the Council of Ministers has confirmed in its letter No. 34238 4/10/2010 this resolution and called for the recovery of salary differences and benefits resulting from the calculation of a political dismissing .
* What are the procedures taken by the Ministry of Finance on the decision No. 81 of 2010?
- The Ministry of Finance / Legal Department has shown in its letter No. 17286 14/4/2011 the mistakes of the administration concerning the cancelling the period provided for by Resolution decision No. 81 of 2010, several letters have been issued in this regard, by both the General Secretariat of the Council of Ministers or the Ministry of Finance, most recently is the decision of the Council of Ministers No. 405 for the year 2011 as stated in paragraph 2 of resolution on the following text: "the financial difference is deducted from the salaries of the above-mentioned rate of not more than 10%, and by functional class.
As stated in paragraph 4 of resolution the following : "This Resolution shall be effective from the date of 01.11.2011" and the decision in paragraph 3 that: "The Ministry of Finance to prepare the necessary instructions to implement the provisions of this resolution."
*Have the dismissed politicians been really redressed?
- After all the decisions that have been issued , the dismissed politicians have not been redressed yet .
