A decision for the Faily Kurds after discussion with the Court of Appeal

Shafaq The MP from the Kurdish coalition blocs said that the delay in issuing a decision by the House of Representatives…

on counting the crimes committed against the Faily Kurds as genocide had come in order to discuss the matter with the Appeals Chamber in the Supreme Criminal Court .
Preezad Sha'aban said in an interview with Shafaq " Many of the House of Representatives believed in postponing the issuance of the resolution in order to explore the judicial body's opinion before making an appeal decision taking into consideration any emergency on this issue so that the decision of the Council is integrated in all the legal aspects."
The Parliamentary Legal Committee announced earlier last month that, they completed the draft resolution in counting the crimes committed against the Faily Kurds as genocide, and voting about it in the House of Representatives will be done   .
The legal expert Tariq Harb said in an interview with Shafaq " The Iraqi Council of Representatives has got full legislative authorities in issuing and  legislating laws and decisions and all what related to activities of the federal legislation under Article 61 of the Constitution," adding, " Therefore the House of Representatives is entitled to issue a resolution about the crimes committed against the Faily Kurds as a crime of genocide, as those crimes were  committed against an ethnic group. " Harb went on, saying, "Because the Iraqi Supreme Criminal Court had issued this decision as a crime of genocide it is better to wait until an appeal decision and the endorsement of the Appeals Chamber of
the Supreme Criminal Court are issued."
